The PsyberGuide Website is owned and operated by One Mind, a California nonprofit public benefit corporation (“OMI,” “We” or “Us”). We have established this policy (the “Privacy Policy”) to outline:

  1. How, and under what circumstances we will collect Personally Identifiable Information from you, our users, via the PsyberGuide Website
  2. How and why we may use and disclose your Personally Identifiable Information
  3. Your rights to the Personally Identifiable Information we collect on the PsyberGuide Website
  4. Your options to edit or delete your Personally Identifiable Information, to withdraw your consent from our use of your Personally Identifiable Information, or to opt-out of the collection of certain kinds of information gathered on the PsyberGuide Website.

When you first visit the PsyberGuide website, we will ask for your affirmative consent to our Cookie Policy.  By using the PsyberGuide Website, you expressly consent to our use, collection, and disclosure/information handling practices as described in this Privacy Polioptcy, and the PsyberGuide Website Terms and Conditions (for users from the European Union, please see Section XIV of this Privacy Policy – “Note to International Users”).

This Privacy Policy is incorporated into, and is subject to, the PsyberGuide Terms of Use. Any terms that are capitalized (e.g. “PsyberGuide Website”, “OM”) and not explicitly defined in this Privacy Policy are defined in the PsyberGuide Terms of Use.

I. Personally Identifiable Information We Collect

To provide you with the best possible experience on the PsyberGuide Website, we will collect, use, and retain Personally Identifiable Information. Personally Identifiable Information, as used in this Privacy Policy, refers to information that can be used on its own or alongside other information to directly identify you, including (but not limited to) your first and last name, telephone number, email-address, location, and/or other online contact information.

A. Personally Identifiable Information that you (or others) voluntarily enter into the PsyberGuide Website.

B. You are not required to create a user account or provide any Personally Identifiable Information in order to visit the PsyberGuide Website. To sign up for our newsletter, you will need to provide us with your first and last name and a valid email address. If you choose to make a donation to PsyberGuide, you will need to provide your payment information and billing information to us through a third party provider. (See Donations section below)

C. Non-identifiable & Passively Collected information

When you use the PsyberGuide Website, we automatically receive and record information sent to our server located in the United States from your browser or device. We may use a variety of methods, including clear GIFs (also known as “web beacons”) and “cookies” (small text files placed on your hard drive that assist us in providing customized services), to collect this information. Please review our Cookie Policy for more information on how we use Cookies to improve your experience.

These automated methods collect your IP address, cookie information, and a unique device or user ID; the name and version of the web browsing application used to visit the PsyberGuide Website; the operating system of the device or computer you are using; the content and pages that you visit on the PsyberGuide Website, and the duration of your visit to PsyberGuide in Hours, Minutes, and Seconds; and the “referring URL” (i.e., the page from which you navigated to the PsyberGuide Website).

We use information collected by passive means only in an aggregated, group-level format, and we will not isolate or investigate any single individuals’ activity on the PsyberGuide Website unless expressly required by law or subpoena.

II. How We Use Personally Identifiable Information

We use Personally Identifiable Information to establish and enhance our relationship with you and others. We may use Personally Identifiable Information in the following ways:

A. Fulfillment of Requests. We may use Personally Identifiable Information about you to respond to your requests, such as to send newsletters to you or to process your donations.

B. Informational Communications. From time to time, and to the extent permitted by applicable law, we may use Personally Identifiable Information about you to inform you of products and services or new features of the PsyberGuide Website that we believe may be of interest to you. If you would prefer us not to send such messages to you, please see the “Opt Out” section below (please note that the provisions in the Opt Out section apply only to the extent permitted by applicable law).

C. Administrative Communications.  From time to time, and to the extent permitted by applicable law, we may use Personally Identifiable Information about you to send to you important information regarding the PsyberGuide Website, including privacy or security-related notices, and changes to our terms, conditions, and policies or other administrative information.  Because this information may be important to your use of the PsyberGuide Website, you may not opt out of receiving such communications; provided, however, this provision concerning opting out does not apply to users from the European Union as users from the European Union may opt out or withdraw their consent to our use of their Personally Identifiable Information at any time as set forth by applicable law.

III. Personally Identifiable Information and Donations

A. Donations. We use a third-party payment service provider Authorize.Net to process donations for us. If you wish to make a donation to us, you will receive an email confirmation automatically generated by Authorize.net. Any Personally Identifiable Information that you provide through the donation page on the Authorize.Net may be collected by Authorize.Net and by us, and will be subject to Authorize.Net’s privacy policy (https://www.authorize.net/company/privacy/) in addition to this Privacy Policy. We have no control over, and shall not be responsible for Authorize.Net’s use of information collected through the Authorize.Net donation page.

PLEASE NOTE THAT THIS PRIVACY POLICY DOES NOT ADDRESS THE COLLECTION AND USE OF INFORMATION THROUGH THE AUTHORIZE.NET DONATION PAGE OR THE PRIVACY OR INFORMATION PRACTICES OF AUTHORIZE.NET.

B. Receipts and Thank You Notes to Donors. We may use Personally Identifiable Information about you to send automatically generated receipts and thank you notes to donors. We may also ask for your permission to post your Name and/or donation level on the PsyberGuide Website. We will only do this if we have your written permission. If you have granted us permission to post your name and/or donation level, and later decide that you’d like to withdraw this permission, please let us know via e-mail at admin@psyberguide.org.

C. Other Purposes. From time to time, we may use Personally Identifiable Information about you (i) to administer, operate, improve and maintain the PsyberGuide Website and our other services and systems, (ii) to develop new products and services, (iii) to prevent abusive and fraudulent use of the PsyberGuide Website, (iv) to  personalize and display content on the PsyberGuide Website or customize our products and services to you, (v) to monitor aggregate site usage metrics such as total number of visitors and pages viewed or to monitor your participation in various sections of the PsyberGuide Website; and (vi) for other customer service, administrative and internal business purposes.  We are committed to your privacy, and we will not rent or sell email addresses nor other Personally Identifiable Information. We do not share Personally Identifiable Information with third parties except in the specific and limited circumstances described in this Privacy Policy.

IV. When We Disclose Personally Identifiable Information

A. Service Providers. Under certain circumstances, we may allow third parties to access your Personally Identifiable Information to allow them to perform services to us (including maintenance services, data analysis, web hosting, IT services, improvement of the PsyberGuide Website’s features as well as accounting, payment processing and other services of an administrative nature). In such cases, we will require those service providers to honor this Privacy Policy.

B. Affiliates. To the extent permitted by applicable law, we may share some or all of your Personally Identifiable Information with our affiliates (including a parent company, subsidiary, joint venture partner or other company that we control or that is under common control with us) so that they may use such Personally Identifiable Information to send you information regarding their websites, products and/or services, in which case we will seek to require those affiliates to honor this Privacy Policy.

V. External Links

PsyberGuide app pages may link to App Stores and Web-Based App URLs. Expert Reviews and Blog posts may also link to external pages including (but not limited to) personal web pages, public domain stock image hosts, news articles, and other forms of web publication. These external links are subject to their own policies and data storage procedures.

To the extent applicable, you have the option of Opting-Out of any information sharing with Affiliates of OMI or the PsyberGuide website.  If you would prefer that we do not share your information with our affiliates, please see the “Opt-Out” section below.

VI. Legal Requirements, Emergencies, & Compliance

A. In the event of a good-faith belief that the disclosure of Personally Identifiable Information is required by subpoena or other judicial order, we reserve the right to do so. We may also exercise the right to disclose Personally Identifiable Information to a third party in the event that we deem it necessary to:

    1. enforce or prevent a violation of the PsyberGuide Terms of Service;
    2. take precautions against liability, pursue solutions, or limit the incurred damages;
    3. protect the rights, property, or safety of PsyberGuide, any individual, or the general public;
    4. maintain and protect the security and integrity of our operations, services, and systems, and those of our affiliates, against fraudulent, abusive, or unlawful uses;
    5. investigate and defend ourselves against third-party claims or allegations; and to
    6. comply with legal processes, respond to governmental requests, or assist government authorities including those that may be outside of your country of residence

VII. Change of Ownership 

In the event of a merger or reorganization with, acquisition by, sale, assignment, transfer or other disposition of our business or assets to, or a joint venture with, another entity, we reserve the right, to the extent permitted by applicable law, to transfer all of your Personally Identifiable Information, including names, email addresses, and phone numbers, to that entity. We will make all reasonable efforts to notify registered users of such a transfer by posting relevant updates on our homepage, or by emailing an update to the an email address that you provided to us, as chosen by us in our discretion).

VIII. Security

We use industry standard security measures to protect against the loss, misuse, and alteration of Personally Identifiable Information under our control. This security measure is called “SSL” or “Secure Sockets Layer”. This is the standard encryption algorithm used to create a secure link between a browser and web address (i.e. “https” vs. “http”). To verify the secure connection, users can look for a browser indicator of SSL functionality. The position and design of a “Secure Connection” indicator may vary by device and operating system.

Though we will make all possible good-faith efforts to protect your information — identifiable or otherwise, we cannot guarantee that it will remain free from unauthorized access, use, disclosure, or alteration.

We work hard to ensure the integrity and security of our network and systems, but we cannot guarantee that our security measures will prevent “hackers” or other unauthorized persons from illegally accessing or obtaining this information.  Therefore, although we use industry standard practices to protect your privacy, we do not promise — and you should not expect — that your Personally Identifiable Information will always remain private.

In the event that we learn of a security breach, we will attempt to notify you electronically, and to undertake all other measures as may be required by applicable law, so that you can take appropriate protective steps.

IX. Security

By using the PsyberGuide Website or providing us with Personally Identifiable Information, you agree that we can communicate with you electronically regarding security, privacy, and administrative issues relating to your use of the PsyberGuide Website.  If a security systems breach occurs, we may post a notice on our homepage (https://one-mind-psyberguide.pantheonlocal.com), or elsewhere on the PsyberGuide Website and may send an email to you at the email address you have provided to us. Depending on where you live, you may have a legal right to receive notice of a security breach in writing.

X. Aggregate Data

By using the PsyberGuide Website, you agree and acknowledge that we may use and disclose to third parties aggregate data in a non-personally identifiable manner for any purposes (including for promotion of OMI or the PsyberGuide Website).

XI. Control Over Information

If the information that you have provided to us changes (such as your e-mail address or telephone number), you no longer wish to receive communications from us or IF YOU WOULD LIKE TO REQUEST OR DELETE ANY PERSONALLY IDENTIFIABLE INFORMATION THAT WE HAVE ABOUT YOU — OR IF YOU WOULD LIKE TO WITHDRAW YOUR CONSENT TO OUR USE OF YOUR PERSONALLY IDENTIFIABLE INFORMATION — PLEASE CONTACT US AT ADMIN@PSYBERGUIDE.ORG AND WE WILL ADDRESS YOUR REQUEST.

Please be aware that even if you update or remove Personally Identifiable Information that you have provided to us, your Personally Identifiable Information may be retained in our backup files and archives for a reasonable period of time for legal purposes.

XII. Third-Party Sites

The PsyberGuide Website may contain links to websites and information regarding products and services provided by third parties. Any Personally Identifiable Information you provide to third parties via use of third-party sites, or use of third party products or services, is provided directly to that third party and is subject to that third party’s policies governing privacy and security. We are not responsible for the content or privacy and security practices and policies of third-party sites. We encourage you to learn about third parties’ privacy and security policies before providing them with Personally Identifiable Information.

XIII. Special Circumstances

A. Note to International Users. The PsyberGuide Website is hosted in the United States. If you use the PsyberGuide Website from the European Union, or any other region with laws governing data collection and use that may differ from United States law, PLEASE NOTE THAT YOU ARE TRANSFERRING YOUR PERSONAL DATA OUTSIDE OF THOSE JURISDICTIONS TO THE UNITED STATES.

B. If European Union General Data Protection Regulation Applies. The United States does not have the same data protection laws as the European Union and other regions. To the extent the General Data Protection Regulation of the European Union (GDPR) applies to the processing of your Personally Identifiable Information, the legal basis therefor is Article 6(1), sentence 1, letter (f) GDPR. Our legitimate interest for processing the Personally Identifiable Information is as set forth under Part II of this Privacy Policy. You have the right to request access to and rectification or erasure of your Personally Identifiable Information, to restrict any processing of your Personally Identifiable Information, to object to any processing of your Personally Identifiable Information, and a right to Personally Identifiable Information portability. You have the right to lodge a complaint with the supervisory authority. If you are a resident of the European Union, you may lodge such a complaint with the supervisory authority of your habitual residence or your place of work. We do not engage in automated decision making, including profiling.

C. By accessing the PsyberGuide Website and making your Personally Identifiable Information available to us, you consent to our use and disclosure of your Personally Identifiable Information in accordance with this Privacy Policy.  You may withdraw this consent at any time by contacting us at admin@psyberguide.org.

Note to California Residents. In addition to the rights set forth in our Privacy Policy, California Civil Code Section 1798.83 permits California residents who are individual users of the PsyberGuide Website to request certain information concerning our disclosure of their Personally Identifiable Information to third parties for direct marketing purposes during the preceding calendar year. To make such a request, please contact us at the mailing or email address provided at the end of this document.

Note Regarding the Use of the PsyberGuide Website by Children. We do not knowingly seek or collect Personally Identifiable Information from users under the age of 13. If we determine we have inadvertently gathered Personally Identifiable Information from a user under the age of 13, we will promptly delete any and all such Personally Identifiable Information from our records. The Children’s Online Privacy Protection Act of 1998 and other laws have been established to protect the privacy of minors and we abide by all federal and state laws and guidelines regarding youth privacy.

Note Regarding HIPAA. By using the PsyberGuide Website, you understand and acknowledge that we are not a covered entity within the meaning of the Health Insurance Portability and Accountability Act of 1996 and its related regulations set forth in Parts 160, 162, and 164 of Title 45 of the Code of Federal Regulations (collectively, “HIPAA”) and are not acting on behalf of a covered entity and that any information you submit to us through or in connection with the PsyberGuide Website that would otherwise be regarded as protected health information for purposes of HIPAA will not be subject to the limitations on the use and disclosure of such information by covered entities under HIPAA.

XV. Opt-Out Procedures for Users Not Located in the European Union

A) Unsubscribe from Communications. If you do not wish to receive newsletters, e-mails or information from us regarding fundraising or products and services that we believe may be of interest to you, or if you would prefer that we do not share Personally Identifiable Information about you on a going-forward basis with our affiliates and/or with third parties, you may opt-out by clicking “Unsubscribe” in the footer of any email we send, or by contacting us via e-mail at admin@psyberguide.org. Please specify clearly which of the following choices you are opting out of:

  1. Receiving newsletters, emails or other information from us
    and/or
  2. Allowing sharing Personally Identifiable Information about you

B) Disable Cookie Collection on the PsyberGuide Website. To block cookie collection for PsyberGuide.org directly, users can click the individualized link below to opt-out of cookie collection.

C) “Do Not Track” Requests. Though there is no established best practice or legal requirement to to honor “Do Not Track” (DNT) requests, PsyberGuide will honor DNT requests. You are not required to log-in to use the PsyberGuide website. If you choose to “share” any element of the PsyberGuide Website on a social media platform, you will not be able to do so without approving an exception to your DNT request. The procedure and settings related to your DNT request will vary by browser, operating system, and platform. Consult your browser’s user manual to determine if your browser supports DNT requests.

In all of the above cases, we will endeavor to comply with your request as soon as is reasonably achievable. Please note that if you opt-out as described above, we will not be able to remove Personally Identifiable Information about you from the databases of third party providers with whom we have already shared Personally Identifiable Information about you as of the date of your opt-out request. If you wish to stop receiving e-mails from third parties, please contact the third parties directly or utilize any opt-out mechanisms set forth in their respective privacy policies or communications with you.

XVI. Updates to This Privacy Policy

We may occasionally update this Privacy Policy. If we do, we will update the “effective date” at the top of this Privacy Policy. If we make an update to this Privacy Policy that is materially less restrictive in our use or disclosure of Personally Identifiable Information that we collected prior to the new Effective Date, we will attempt to notify you of the change.

We will post the updated Privacy Policy on the Website, and if we have your email address, we will send notice of the update to that email address. We encourage you to periodically review this Privacy Policy to stay informed about our collection, use, and disclosure of Personally Identifiable Information on the PsyberGuide Website.
